Do I need an attorney when I buy a house?
Real estate dealings are a complicated environment. With so much
to think about and so much pressure to get everything right some people can
feel overwhelmed.
In some cases your realtor will be able to help you with most of
the problems and scenarios that you come up against however, some people decide
that, for extra piece of mind, to hire a lawyer to handle all of the
contractual and fine detail areas of the deal.
Hiring a lawyer is okay for some people, especially if money isn’t
a concern, but for those who may not want to hire a lawyer you should find out
if it is actually mandatory or not.
In some states of the U.S
you are legally required to hire an attorney to represent you in real estate
dealings, however this is not all of the sates so you should ask your realtor
for their advice and opinion on this matter.
The majority of homebuyers are
very capable of handling all of the routine real estate purchase contracts, so
long as they make sure to read the fine print. You must always be 100% certain
of what you are signing, as you will be legally liable for what you sign.
Always read and understand all the terms of the contract and all the fine
print.
If you decide not to hire a
lawyer you should make sure that you are clear on the terms of any contingency
clauses that will allow you to back out of the contract should you need to,
otherwise you could be financially liable for any costs incurred and stated in
the contract.
If you do feel that hiring a
lawyer is the right way to handle the real estate contracts then that is okay
too. Lawyers are qualified and experts in contract terminology so that you can
feel at ease that you know exactly what you are entering into and what the
consequences and escape routes are.
